    IQ Unlock LLC ("IQUnlock," "Company," "we," "our," or "us") respects your privacy and is committed to protecting the personal information entrusted to us. This Privacy Policy explains how we collect, use, disclose, retain, and protect information obtained through the IQUnlock mobile application, the website located at https://www.iqunlock.com, and any related products, services, features, content, and functionality (collectively, the "Services").

    By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy.

    1. WHO WE ARE

    IQUnlock provides educational, gamified learning, family engagement, rewards, and financial literacy tools designed for use by families, including parent-managed child accounts. The Services allow parents or guardians to create and administer accounts, monitor progress, establish spending and reward parameters, fund rewards, and manage redemption requests.

    2. INFORMATION WE COLLECT

    The information we collect depends on how you interact with the Services.

    Information Collected from Parents, Guardians, and Adult Users

    We collect the following categories of personal information from parents, guardians, and other adult users: 

    (1) Identifiers, including name, email address, telephone number, account credentials, and account identifiers;

    (2) Account Information, including account status, subscription information, family-account information, and information necessary to administer and maintain user accounts;

    (3) Financial and Transaction Information, including payment-related information, wallet deposits, subscription purchases, transaction records, payout-related records, and reward-related transaction history;

    (4) Communications Information, including email addresses, telephone numbers, and information necessary to deliver transactional emails, SMS messages, push notifications, and other service-related communications; 

    (5) Device and Technical Information, including device identifiers, push-notification tokens, application version information, operating system information, security logs, diagnostic information, and other technical information reasonably necessary to operate, maintain, and secure the Services; and

    (5) User-Provided Information, including information voluntarily submitted through the Services.

    When an adult user chooses to use a third-party sign-in service, such as Apple Sign-In, Google Sign-In, or Facebook Login, we may receive information made available by the applicable authentication provider, including the user's name, email address, and account identifier. 

    Information Collected in Connection with Child Accounts

    Children may not independently create accounts. Child accounts are created and managed through a parent-controlled account. 

    We collect the following information in connection with child accounts. Certain fields are optional and are collected only if provided by a parent or legal guardian. Child account information includes: (1) a nickname, (2) a username, (3) a birth year, (4) a first name and last name, if provided, (5) a grade level, if provided, (6) a school name, if provided, (7) state and country information, (8) spending limits established by a parent or guardian, (9) internal reward and credit balances, (10) a profile photograph, if provided, and (11) account credentials established and managed by the parent or guardian. 

    Transaction and Reward Information 

    We collect and maintain records relating to family-wallet deposits, payment transactions, subscription purchases, internal IQU credits, educational activities associated with the earning of IQU credits, payout requests, reward redemptions, gift-card fulfillment transactions, transaction histories, and related accounting and ledger records necessary to administer the Services.

    Device and Technical Information

    We collect and maintain technical information reasonably necessary to operate, secure, and maintain the Services. This information includes push-notification tokens, account-authentication records, security and access logs, technical information associated with the delivery of transactional communications, and other technical information necessary to support the functionality, integrity, and security of the Services.

    Information We Do Not Intentionally Collect from Child Users

    Based on the current design of the Services, IQUnlock does not collect location information, device identifiers, or usage analytics from child users. IQUnlock does not intentionally collect additional categories of personal information from child users except as reasonably necessary to provide, maintain, secure, and administer the Services.

    3. HOW WE USE INFORMATION

    We use personal information to provide, operate, maintain, administer, secure, and improve the Services.

    Specifically, we use personal information to: (1) create, administer, and manage user and family accounts; (2) authenticate users and maintain account security; (3) provide educational activities, quizzes, rewards, and related features; (4) track, award, and administer IQU credits, reward balances, and redemption requests; (5) process wallet deposits, subscriptions, payment transactions, and gift-card reward fulfillment; (6) communicate with users regarding their accounts, transactions, subscriptions, and use of the Services; (7) deliver transactional emails, SMS messages, and push notifications; (8) monitor, maintain, and protect the security, integrity, and functionality of the Services; (9) investigate and prevent fraud, abuse, unauthorized activity, and security incidents; (10) enforce our agreements, policies, and legal rights; (11) comply with applicable legal, regulatory, accounting, and reporting obligations; and (12) protect the rights, safety, property, and security of IQUnlock, its users, and others. 

    4. CHILDREN'S PRIVACY

    For purposes of this Privacy Policy, "Children" means individuals under thirteen (13) years of age.

    IQUnlock includes features intended for use by Children under the supervision and control of a parent or legal guardian. We recognize the importance of protecting Children's privacy and seek to operate the Services in a manner consistent with the Children's Online Privacy Protection Act ("COPPA") and other applicable laws governing Children's information.

    Child accounts may only be created by a parent or legal guardian through a parent-controlled account. Children are not permitted to independently register for the Services. Child profiles may be created only by an authenticated parent through the account-creation process. 

    In connection with child accounts, we collect only the information reasonably necessary to provide the educational, rewards, family engagement, authentication, security, and account-management functions of the Services. The categories of information collected from Children are described in Section 2 of this Privacy Policy.

    We use information associated with child accounts to provide and administer the Services, maintain account functionality and security, facilitate educational activities and rewards, administer IQU credits and balances, process approved redemption requests, communicate with parents and guardians regarding the Services, comply with legal obligations, and protect the integrity, safety, and security of the Services.

    Based on the current design of the Services, IQUnlock does not collect location information, device identifiers, or usage analytics from Children.

    Parents and legal guardians may review information associated with their child's account, request correction of inaccurate information, request deletion of information associated with their child's account, revoke consent for the further collection, use, or disclosure of the child's personal information, or request termination of the child's participation in the Services. Before granting such requests, we may take reasonable steps to verify the identity and authority of the requesting parent or legal guardian.

    We do not condition a Child's participation in the Services on the disclosure of more personal information than is reasonably necessary for participation in the applicable activity.

    5. VERIFIABLE PARENTAL CONSENT

    IQUnlock requires verifiable parental consent before a Child under the age of thirteen (13) may access or use the Services.

    Prior to activating a Child account, IQUnlock provides the parent or legal guardian with a direct notice describing the categories of information collected from Children, the purposes for which such information is collected and used, the circumstances under which such information may be disclosed, and the rights available to parents and legal guardians regarding their Child's information.

    A Child account may only be created through a parent-controlled account. Before activating a Child account, IQUnlock requires the parent or legal guardian to review and affirmatively accept the applicable Privacy Policy, Terms of Use, and Children's privacy disclosures.

    Direct Notice to Parents

    When IQUnlock seeks to collect personal information from a Child, we first provide notice to the parent or legal guardian describing:

    (1) the information collected from the Child;

    (2) how the information will be used;

    (3) how the information may be disclosed;

    (4) the parent's rights regarding the Child's information; and

    (5) the process for granting or withholding consent.

    If required parental consent is not received within a reasonable period, IQUnlock may decline to activate the Child account and may delete information collected in connection with the incomplete registration process, except as otherwise permitted or required by law.

    Methods of Verifiable Parental Consent

    To help ensure that consent is provided by a Child's parent or legal guardian, IQUnlock may use one or more methods reasonably designed to verify parental authority and identity. Depending on the circumstances, such methods may include:

    (1) verification through a payment-card transaction or other payment method associated with the parent or legal guardian;

    (2) authentication through a verified parent account;

    (3) submission of a signed consent form electronically or by other approved means;

    (4) communication with a trained representative by telephone or video conference; or

    (5) any other method permitted under applicable law.

    The specific verification method used may vary depending on the nature of the information collected and the risks associated with the activity.

    Consent Records

    IQUnlock may maintain records related to parental consent, including the date and time consent was provided, the identity of the consenting parent or legal guardian, the version of the Privacy Policy and Terms of Use accepted, and the method used to verify consent. Such records are maintained for compliance, audit, security, dispute-resolution, and legal purposes.

    Revocation of Consent

    A parent or legal guardian may revoke previously provided consent at any time by contacting IQUnlock using the contact information provided in this Privacy Policy. Upon revocation, IQUnlock may suspend or terminate the applicable Child account and delete associated personal information, subject to legal, accounting, security, fraud-prevention, and record-retention obligations.

    6. DISCLOSURE OF INFORMATION

    We do not sell personal information.

    We disclose personal information to service providers and vendors that assist us in operating the Services. These providers currently include: (1) Stripe, which processes payment transactions and subscription-related payments; (2) Tremendous, which facilitates digital gift-card fulfillment; (3) Amazon Web Services Simple Email Service, which delivers transactional email communications; (4) Twilio, which facilitates SMS communications; (5) Firebase Cloud Messaging, which supports push notifications; and (6) authentication providers, including Apple, Google, and Facebook, when users choose to sign into the Services using those authentication services. 

    We may disclose personal information when we reasonably believe disclosure is necessary to comply with applicable law, regulation, subpoena, court order, governmental request, legal process, or law-enforcement request.

    We may also disclose personal information when necessary to detect, investigate, prevent, or respond to fraud, abuse, unauthorized activity, security incidents, violations of our agreements, threats to the security or integrity of the Services, or circumstances affecting the rights, safety, or property of IQUnlock, its users, or others.

    If IQUnlock is involved in a merger, acquisition, financing transaction, corporate reorganization, bankruptcy proceeding, or sale of assets, personal information may be transferred as part of that transaction, subject to applicable legal requirements.

    7. PAYMENT PROCESSING AND REWARDS

    Financial transactions conducted through the Services are processed by third-party service providers. Wallet funding transactions and subscription-related payment processing are conducted through Stripe. Approved gift-card reward fulfillment is conducted through Tremendous. 

    IQUnlock receives and maintains transaction-related information necessary to administer the Services, including records relating to wallet deposits, subscription purchases, reward credits, payout requests, gift-card fulfillment, transaction histories, and related accounting and ledger records. Payment processing activities are performed by Stripe in accordance with its applicable terms and privacy practices.

    8. ARTIFICIAL INTELLIGENCE FEATURES

    The Services use artificial intelligence technologies to support the generation of educational content, including quizzes and related learning activities. IQUnlock currently utilizes OpenAI and may utilize other artificial intelligence service providers as the Services evolve. Based on the current design of the Services, user personal information is not provided to such service providers in connection with quiz generation. 

    If IQUnlock materially changes its use of artificial intelligence technologies or the categories of information used in connection with those technologies, this Privacy Policy will be updated to reflect those changes.

    9. DATA SECURITY

    We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction.

    Our security measures include account authentication controls, password-based access controls, restricted child-account creation through authenticated parent accounts, security logging, and other safeguards designed to support the security and integrity of the Services.

    We also implement additional security measures that are appropriate to the nature of the information processed and the functionality of the Services.

    Although we take reasonable measures to protect personal information, no method of electronic transmission, storage, or security can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

    10. DATA RETENTION

    We retain personal information for as long as reasonably necessary to provide and administer the Services, maintain business, financial, accounting, and transaction records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and protect the security and integrity of the Services.

    The length of time for which personal information is retained depends on the nature of the information, the purpose for which it was collected, applicable legal requirements, operational needs, and dispute-resolution requirements.

    11. U.S. STATE PRIVACY RIGHTS

    Residents of certain U.S. states may have rights regarding their personal information under applicable law. Depending on the applicable law and the circumstances involved, such rights may include: (1) the right to know whether we process personal information about them; (2) the right to access personal information; (3) the right to correct inaccuracies in personal information; (4) the right to request deletion of personal information; (5) the right to obtain information regarding certain disclosures of personal information; (6) the right to receive a portable copy of personal information; (7) the right to opt out of certain processing activities where such rights are provided by law; and (8) the right to appeal a determination concerning a privacy request.

    IQUnlock will evaluate and respond to verifiable privacy requests in accordance with applicable law. Privacy requests may be submitted using the contact information provided in this Privacy Policy.

    We may take reasonable steps to verify the identity of the individual submitting a request before providing a substantive response.

    Certain privacy laws apply only when specified legal thresholds are met. Nothing in this Privacy Policy shall be construed as an admission, representation, or acknowledgment that any particular state privacy law applies to IQUnlock at any given time. Nevertheless, IQUnlock endeavors to provide meaningful privacy protections to all users and will review and respond to privacy requests in good faith and consistent with applicable law.

    12. DO NOT TRACK SIGNALS

    Because there is currently no universally accepted standard for responding to browser-based "Do Not Track" signals, the Services may not respond to such mechanisms.

    13. THIRD-PARTY WEBSITES AND SERVICES

    The Services utilize and may provide access to third-party websites, applications, platforms, products, and services, including payment-processing providers, reward-fulfillment providers, authentication providers, messaging providers, and other service providers that support the operation of the Services.

    When users access or interact with third-party websites, applications, or services, the collection, use, disclosure, and protection of personal information are governed by the privacy policies and terms of those third parties, not this Privacy Policy.

    IQUnlock is not responsible for the privacy, security, content, or practices of third-party websites, applications, platforms, products, or services. Users should review the applicable privacy policies and terms before providing personal information to any third party.

    14. INTERNATIONAL USERS

    IQUnlock is intended for users located in the United States. The Services are designed for U.S.-based operations, and transactions are processed in U.S. dollars.

    If you access or use the Services from outside the United States, you acknowledge that your information may be collected, processed, stored, and transferred in the United States, where privacy and data protection laws may differ from those in your jurisdiction.

    By accessing or using the Services, you consent to the transfer, processing, storage, and use of your information in the United States as described in this Privacy Policy. 

    15. CHANGES TO THIS PRIVACY POLICY

    We may revise this Privacy Policy from time to time. When changes are made, we will update the Effective Date above and provide any notice required by applicable law. Continued use of the Services after a revised Privacy Policy becomes effective constitutes acknowledgment of the updated Privacy Policy.
